Dealership Buy/Sells and DMV License Use Agreements; Buyer Must Apply within 15 days of Notice or Seller’s License is Revoked

As of February 28, 2013, the Florida Department of Highway Safety and Motor Vehicles (“DMV”) has established some new procedures that every buying dealer must be aware of. As a part of every dealership transfer in Florida, we utilize a Temporary License Use Agreement whereby the buyer is authorized the temporary use of the seller’s DMV License for approximately 45 days. Following your closing and the parties mutual notice to the manufacturer that the “deal is done,” the manufacturers are required to give notice to the DMV of the change. Thereafter, under the new procedures, DMV has to give the buying dealer a letter giving them an additional 15 days to complete their application for their new seller’s license. If the buyer fails to get their application in on time, the License Use Agreement from the Seller won’t be worth the paper it’s printed on, the DMV License will be revoked, and other penalties will result.
